Long Island Separation Lawyers
For a separation, issues as child custody, child and/or spousal maintenance, or matrimonial property division are best settled by written agreements which are legally enforceable. It is crucial to have an attorney who can advise you of your legal rights, and obtain a fair and equitable written agreement.
A separation agreement is a formal agreement between you and your spouse. The phrase "legal separation" is usually used to mean that the spouses have signed a contract, called a separation agreement, which settles all of their marital property rights, alimony claims, and other issues - but they have not yet obtained a divorce.
A separation agreement provides for support and other financial conditions until the divorce is final. This is in the form of a court order, as this agreement is not binding without a court order. If you and your spouse can negotiate and agree on the terms, you probably won't have to appear in court, as your attorney will take the signed agreement to the judge who will sign it thereby making it a court order.
